Fees
Please bear in mind, our services for filing an application with the United States Patent and Trademark Office and/or the Copyright Office does not guarantee that your trademark/servicemark and/or copyright will be registered.
Trademark/Servicemark Registration or ITU Application*: $450 per class (plus $325 per class government filing fee)
- Draft and file your application to register with the USPTO.
- Respond to up to two Office Actions (see below)
NOTE: We act as your agent, so we sign for you and receive all communication from the USPTO. You will receive copies of all correspondence and communication in the mail as the process unfolds. The fee includes basic costs such as mailing, copying, and telephone calls. If the USPTO files an Office Action (a denial of your application) concerning minor technical issues, we will respond to it in writing, up to two times. It is uncommon for more than one Office Action. However, any additional work requested or agreed to by you, such as handling substantive responses to Office Actions (e.g., likelihood of confusion, acquired distinctiveness, etc.); defending you in Opposition proceedings; application appeals; research; and renewals shall be billed at Attorney’s-then hourly rate for time actually devoted to the service of your trademark or servicemark, together with reimbursement for all related expenses, including any additional government fees.
Additional Fees Apply To ITU Applications:
Statement of Use: $100 fee per class (plus $100 non-refundable governmental filing fee per class)
Extensions of Time to File Statement of Use: $100 fee per class (plus $150 non-refundable governmental filing fee per class) each time ITU applicant wishes to extend the time to file a Statement of Use
Comprehensive Trademark Search
Word Mark: $550
- Search Federal, State, Common Law, UK, Germany, European Community, WIPO, and Internet Databases
- Search for Direct Matches
- Search for phonetic equivalents (Word Mark Only)
- Review for common Trademark Office rejections
- Full Attorney Opinion Letter
Comprehensive Design Search: Call For A Quote
- Rates depend on how many International Classes need to be searched
- Search Report and Opinion prepared by an attorney
Trademark Monitoring (Annual Rate Per Mark): $925 (for 1 Mark); $900 (for 2-5 Marks); $875 (for 6 Marks)
- Monthly monitoring for confusingly similar trademarks in the USPTO database
- Monthly searches of general Internet search engines
- Electronic monitoring of your trademark registration renewal dates
- A detailed report sent via e-mail on amonthly basis.
NOTE: Additional work requested or agreed to by you, such as having an attorney prepare and draft a cease and desist letter, shall be billed at Attorney’s then-hourly rate for time actually devoted to the investigation and preparation of the correspondence to the potentially offending party and any subsequent correspondence and/or communications with the offending party, including research (if necessary), together with reimbursement for all related expenses.
Federal Copyright Registration: $400 (plus $35 U.S. Copyright Office fee)
The fee includes basic costs such as mailing, copying and telephone calls. It does not include drafting copyright assignments.
NOTE: On occasion, the U.S. Copyright Office may refuse a copyright application. If this were to occur, any additional work requested or agreed to by you, such as Requests for Reconsideration, appeals, research, and renewals shall be billed at Attorney’s then-current hourly rate for time actually devoted to the service of your copyright, together with reimbursement for all related expenses, including any additional government fees.
